নারায়ণগঞ্জের সোনারগাঁ উপজেলায় টক অফ দা টাউন এ পরিনত হয়েছে সাত ভাইয়াপাড়া গ্রামের এক কিশোরী ও একই গ্রামের জাহাঙ্গীর হোসেন শিকদারের পালিয়ে বিয়ে করার ঘটনা, অপহরণ মামালা ও ফেসবুক লাইভে মেয়ের বক্তব্য।
এখন জনমনে প্রশ্ন পালিয়ে বিয়ে করলেই কি অপহরণ মামলা?

এ ঘটনায় মেয়ের বাবা জাহাঙ্গীর হোসেন শিকদারের বিরুদ্ধ থানায় অপহরণের অভিযোগ দায়ের করেন। অপর দিকে মেয়ে ফেসবুক লাইভে এসে বলছে, আমাকে অপহরণ করে নাই কেউ। জাহাঙ্গীর হোসেন শিকদারের সাথে আমার ভালোবাসার সম্পর্ক। আর ভালােবাসার টানে তাকে নিয়ে আমি পালিয়ে বিয়ে করেছি। জাহাঙ্গীর হোসেন শিকদার আমাকে বিয়ে না করলে আমি আত্মহত্যা করবো বলে, তাকে আমি বাধ্য করেছি আমার সাথে পালিয়ে বিয়ে করতে।

ভালোবাসার মানুষটির জন্য নিজের পিতার অভিযোগের বিরুদ্ধে ফেসবুক লাইভে এমন দুটি ভিডিও বক্তব্য সামাজিক যােগাযােগমাধ্যমে ভাইরাল হয়েছে। যা সোনারগাঁজুড়ে আলােচনা সমালােচনার মধ্য দিয়ে এ বিষয়টি টক অফ দা টাউন এ পরিনত হয়েছে।

মেয়ের পিতা আহসান উল্লাহ বলছেন, মেয়ের বয়স ১৮ বছর হয়নি। মেয়ে যাই বলুক, আইনে তা গ্রহণযােগ্য নয়। তাই ছেলের বিরুদ্ধে নারী ও শিশু নির্যাতন আইনে মামলা হয়েছে।

মেয়ের পিতা অভিযোগে উল্লেখ করেন, সাত ভাইয়াপাড়া গ্রামের বাসিন্দা জামান মিয়ার ছেলে জাহাঙ্গীর হোসেন ওরফে শিকদার আমার বোনের বাড়ীতে যাতায়াত ছিল। সেই সুবাদে আমার মেয়ের উপর চোখ পরে। পরে গত ৩ মার্চ সন্ধ্যায় শিকদার ও লোকজন তার মেয়েকে অপহরণ করে অজ্ঞাত স্থানে নিয়ে যায়। পরে শিকদারের মুঠোফোন ও তার মেয়ের ব্যবহৃত মুঠোফোন বন্ধ পাওয়া যায়। শিকদারের পরিবারের লোকজনও তাদের হুমকি দিয়ে যাচ্ছে।

এ বিষয়ে বাংলাদেশ পুরুষ অধিকার ফাউন্ডেশন, সোনারগাঁয়ের উপদেষ্টা হাজী মোঃ শাকিল রানা বলেন, আমাদের সমাজে এমন ঘটনা অহরহ ঘটতে দেখা যাচ্ছে। প্রায়ই দেখা যায়, প্রেমিক যুগল মা-বাবার অমতে পালিয়ে বিয়ে করে।
কিন্তু নিজেরা বিয়ে করতে গিয়ে বিয়ের নিয়মকানুন না জানার কারণে অনেক সময় পড়ে বিপদে।

পালিয়ে বিয়ে এটা প্রেমের চুড়ান্ত রুপ। তার আগে দীর্ঘদিন চলে প্রেমের সম্পর্ক। অনেক ঘটনা বা অনেক কিছু হয়। তখন অভিভাবকরা সতর্ক হলে এমন অনাকাঙ্ক্ষিত ঘটনা বন্ধ করা সম্ভব হতে পারে। আর মুসলিম উম্মাহর ভিতরে এমন অভিযোগ কখনই উঠতোনা যদি শরয়ী বিধান পর্দা সম্পর্কে জ্ঞানার্জন বাধ্যতামূলক বা নিয়মিত চর্চা করাতে পারতাম নিজেদের সন্তানদের ভিতর বা সমাজে ও রাষ্ট্রে।

তবে দূর্ভাগ্যজনক বিষয় হচ্ছে, এই অসামাজিক ও অনাকাঙ্ক্ষিত কার্যকলাপের কারণে দুজনই সমান অপরাধী হলেও আমাদের আইনে শুধু পুরুষের বিরুদ্ধে বহু ধরা। মহিলাদের বিরুদ্ধে অর্ডিন্যান্সে কোন ধারাই নাই।

তাই মেয়ের বক্তব্য যদি সত্যি হয়, আর সিকদার নির্দোষ হয়, তাহলে বাংলাদেশ পুরুষ অধিকার ফাউন্ডেশন সোনারগাঁ শাখা তার পাশে থাকবে। কোন মিথ্যা মামলা সফলকাম হয় না।

সোনারগাঁ থানার ওসি রফিকুল ইসলাম জানান, এ বিষয়ে থানায় অভিযোগ নেওয়া হয়েছে। অপহৃত কিশোরীকে উদ্ধারের চেষ্টা চলছে।

আইন কী বলে?
পরিবারের অমতে বিয়ে করতে গিয়ে এখন অপহরণের মিথ্যা অভিযোগ জাহাঙ্গীর হোসেন শিকদারের বিরুদ্ধে। করন মেয়ের বয়স ১৮ বছর না হওয়া। বিয়ের কথা জানাজানি হওয়ার পর মেয়ের পিতা অপহরণের মামলা ঠুকে দেন শিকদারের বিরুদ্ধে।

অনেককেই বলতে শোনা যায় ‘কোর্ট ম্যারেজ’ করেছে। কিন্তু কোর্ট ম্যারেজ সম্পর্কে না জানার কারণে পরবর্তী সময়ে অনেক ঝামেলাও পোহাতে হয়। আইনে কোর্ট ম্যারেজ বলে কোনো বিধান নেই। এটি একটি লোকমুখে প্রচলিত শব্দ।

কোর্ট ম্যারেজ বলতে সাধারণত হলফনামার মাধ্যমে স্বামী-স্ত্রীর মধ্যে বিয়ের ঘোষণা দেওয়াকেই বোঝানো হয়ে থাকে। এ হলফনামাটি ২০০ টাকার নন-জুডিশিয়াল স্ট্যাম্পে লিখে নোটারি পাবলিক কিংবা প্রথম শ্রেণির ম্যাজিস্ট্রেটের সামনে সম্পন্ন করা হয়ে থাকে। এটি বিয়ের ঘোষণা মাত্র।

যে ধর্মেই হোক না কেন, স্বামী-স্ত্রীর মধ্যে পারিবারিক আইন অনুযায়ী প্রথমে বিয়ে সম্পন্ন করতে হবে। তারপর তাঁরা ইচ্ছা করলে এ হলফনামা করে রাখতে পারেন।

মুসলিম আইনে বিয়ে নিবন্ধন করা বাধ্যতামূলক।

হিন্দু আইনে বিয়ে নিবন্ধন ঐচ্ছিক করা হয়েছে।

ছেলেমেয়ে মুসলমান হলে কাবিননামা সম্পন্ন করে না থাকলে স্বামী বা স্ত্রী হিসেবে দাবি করতে গিয়ে ভোগান্তিতে পড়তে হয়।

পালিয়ে বিয়ে করলেই কি অপহরণ মামলা ?

বিয়ের প্রথম শর্ত হচ্ছে ছেলেমেয়েকে প্রাপ্তবয়স্ক হতে হবে। ছেলের বয়স ২১ ও মেয়ের বয়স ১৮-এর ১ দিনের কম হলেও বয়স গোপন করে বিয়ে করলে মামলা-মোকদ্দমায় পড়ার আশঙ্কা থাকবে।

বিশেষ করে মেয়ের বয়স ১৮-এর কম হলে মেয়ের অভিভাবক অপহরণের মামলা ঠুকে দিলে ছেলেটির বড় ধরনের জেল-জরিমানার সম্মুখীন হওয়ার আশঙ্কা থাকে।

আবার মেয়েটি আদালতে গিয়ে স্বেচ্ছায় বিয়ে করেছে মর্মে জবানবন্দি দিলেও প্রাপ্তবয়স্ক না হওয়া পর্যন্ত নিরাপদ হেফাজতেও থাকা লাগতে পারে।

তাই নিজেদের পছন্দ অনুযায়ী বিয়ে করতে গেলে আইনকানুনও মানতে হবে। তবে মেয়ে যদি প্রাপ্তবয়স্ক হন, তাহলে অপহরণের মামলা করেও কোনো লাভ হয় না।

বরং মিথ্যা মামলা করার অভিযোগে মামলা দায়েরকারীকেই উল্টো সাজা পেতে হয়।

যা মনে রাখতে হবে- ভালোবাসার মানুষকে নিয়ে ঘর বাঁধার স্বপ্ন কে না দেখে? তাই বলে স্বপ্নে একেবারে অন্ধ হয়ে গেলে হবে না। অনেক সময় ভালোবাসার মানুষটিই হয়ে যেতে পারে প্রতারক।

দু-একটি ঘটনায় দেখেছি, বিয়ের নামে ভুয়া বিয়ের দলিল তৈরি করে মেয়েটির সঙ্গে কয়েক দিন স্বামী-স্ত্রীর মতো একান্ত সময় কাটিয়ে ছেলেটি সরে পড়ে। হয়ে পড়ে নিরুদ্দেশ। তখন মেয়েটি পড়ে যায় বিপদে। অনেক সময় মেয়েটি গর্ভবতীও হয়ে পড়ে। ফলাফল, বিয়ে প্রমাণ করতে না পেরে সইতে হয় অপমান-বঞ্চনা।

তাই ভালোবাসায় আস্থা থাকবে, কিন্তু তার সঙ্গে সঙ্গে হতে হবে একটু সচেতন। বিয়ে করলে কাবিননামা বা বিয়ের দলিল দুজনের কাছেই রাখতে হবে।

আর শুনতে খারাপ লাগলেও ভালোবাসার মানুষটির হাত ধরে বেরিয়ে আসার আগে একটু ভালো করে খোঁজখবর নিয়েই নেন না। বিয়ে তো আর ছেলেখেলা নয়।
